Photographer's Contract

 

This Agreement is made the___________________day of _________between Artseens Photo Agency. 45 Avondale Court. London. E16 4PU.

(hereinafter called the Agency) of the one part and (hereinafter called the "The Photographer") of the other part.

Whereas it is agreed that:

The photographer appoints the Agency as the exclusive worldwide agent for the marketing of his photographs lodged within the agency's library except for the territories here mentioned.

The Agency shall have complete authority to act on the behalf of the photographer in all matters related to the photographs placed with it including the negotiations of fees and rights.

The Photographer warrants that all photographs placed with the Agency are his / her property and copyright. Also model release is available unless expressly stated to the contrary on the photographs or the mount.

The photographer agrees to indemnify the Agency against any third party claims where the Agency has in the ordinary course of business offered the photographs on his / her behalf.

The Agency's commission for acting on behalf of the photographer is fifty (50%) per cent of all money received by the Agency as revenue earned by the photographs placed with the Agency by the photographer.

The Agency agrees to settle quarterly all payments due to the photographer after all reasonable costs incurred in syndicating the photographs worldwide have been deducted.

The Agency cannot accept any responsibility for any photographs delivered by the Agency to a third party in the normal course of business. The Agency's terms and conditions assign responsibility for the photographs to the client whilst in the client's possession and until their safe return to the Agency.

The Photographer Agree to insure his / herself against of income as a result of damages incurred to his / her photographs whilst in Poisson of a third party.

 

Any photographs deposited with the Agency by the photographer will be retained for a minimum of 36 months from the date of the deposit. Thereafter the photographer may withdraw his / her photographs prior to the giving of 12 months notice in writing subject to their having been deposited with library for at least 36 months, or as previously agreed.

Termination of this agreement is without prejudice to all ongoing negotiation that the Agency has properly entered into with any third party.

In the foregoing paragraphs the term Photographs shall include transparencies, prints digital CDs and e-mail's ftp. Where appropriate.

For freelance photographers. Any time we book a photographers for to cover any photo shoots 20% will paid to Artseens of the total amount. We hold the copyright of all the negatives of photographs.

This document contains the entire agreement between the parties and takes the place of all other agreements whether oral or written is not set out herein and will not be effective.
